Dear friends,

            Summary of discussions: conflict of interest within the CCM, we all known about the leader of the nation / project implementer especially the private fund implementations. While I gone through the studies about the government as a primary implementation, the mechanism may be constrained by the politician and other power leaders of that area. The CCM have to adopt that what they instruct to do. Due to this nature the primary recipients/sub recipients/local fund agency may have to adopt the regulations as framed by these politicians/powerful persons but, the partners of the global fund are not depend any political party, they may not be a elected member of any organization. At this juncture, I clearly express my view that the global fund have to give clear cut policies , about the selection of the global fund’s implementing agencies, their eligible criteria, able to conducted the programme more over those organization are working within the pandemic disease like AIDS/malaria/tuber closes further my opinion is that, the my global fund’s secretariat should frame a specific rules & regulation, planning of implementations, monitoring & evaluation and etc and it should be strictly followed by the my global fund.

            In some CCM member may have availed the global fund at their working area. I feel that, these CCM members may or may not encourage the new principle recipients/ sub recipients LFA s. At this point my global fund may seek the whole project applicants analysis those and advice to the CCM as per the merits of the applicants. This has to be monitor by the secretaries of the my global fund

Summary of discussions: Conflict of interests within the CCM

When does a conflict of interests arise?

 

1.      Most conflicts of interests arise when a member of the CCM applies to become a Principal Recipient (PR) or Sub-Recipient (SR). This kind of member can easily dominate the decisions of CCM during selection process, as well as oversight during implementation

 

2.      If CCM members are sub-recipients of the Global Fund grant, there will always be conflict of interest during the process of reviewing proposals. Members of the CCM could be influenced to favour them thereby affecting the chances of others wanting to benefit from the grant.

 

3.      Conflicts of interest are often created by members of the CCM Executive Board through ignorance (unconsciously, through incompetence) or deliberately (for financial gains).

 

4.      This question underlines the representation of the public sector in CCM; civil society is usually not a principal recipient, but a sub-recipient, represented by NGOs that can seek and obtain CCM membership.

 

The need for stricter guidelines

5.      The clear-cut solution is that such a member should resign from the CCM before a call for proposals. However, this can mean that a CCM may face losing qualified people from its membership.

 

6.      When we talk of clearer policies and guidelines, we mean precise, updated and genuine information that will put people in the know so that they act appropriately.

 

7.      Participation in the CCM should have clearer norms in terms of who receives the funds. Conflict handled properly, leads to creativity.

 

8.      Conflicts of interests very much depend on the rules that each CCM sets, so the Global Fund should ensure that the proposal that is submitted corresponds to the national plan of action and that does not “belong” to a particular organization.

 

A PR or SR’s position in the grant life-cycle

 

9.      A PR or SR should not remain in a Chair or Vice-Chair position; they should not have the right to vote on issues related to their own organization's interests. 

10. It is already a challenge in some countries that the Chair is from the government while the PR is from another government department or ministry.

11. One solution could be that the Ministry of Finance is a member of the CCM and the Ministry of Health implements the program. This way, the conflicts of interest can be better addressed.

 

 

Mechanisms to deal with conflict of interests should be established

 

12. Instead of sub-recipients sitting on a CCM, they should be accommodated in the disease specific committees (the Inter-agency Coordinating Committees) where they could ensure their interests are taken care of.

 

13. The policy of preventing conflict of interest exists – it is written in program agreements – but the mechanisms to curb conflicts of interests do not. The Global Fund is obliged to establish these.

 

14. Proper monitoring and regular evaluation of the CCMs is needed in order to ensure that a PR is not linked to or a puppet of the CCM, and vice versa.

15. The roles of the CCM, PR and SR should be clearly defined to ensure that they work to achieve the country proposal objectives and not to serve a particular organization.

Technical Assistance

 

16. It is important to provide technical assistance to CCM members in order to improve their skills in good governance and management.

 

Increase transparency

 

17. There should be a committee to manage the conflicts of interests whenever the need arises. The members of this committee would be appointed on the basis of impartiality, ethics and professionalism.

 

18. Decisions taken at general CCM meetings should be published.

To, CCM(CONFLICT OF INTEREST) In developing Asian,African & less socio-constitutional institutional countries,for understanding of civil-rights,democratic approaches, constitutional& political accountability,formal funding arbitration structure for PR,SR,&OPR,GF mechanism should have clearer policies &guidelines to mitigate the inherent conflict of interest. Clearer policies & guidelines should be formulated for formal relationship to partner environment,transparent,open participation decision making,interdependence,funding priority,acceptability of GF projects by countries,prevention of bureaupathology in CCM linkage, GF funding arbitration structure should consist of contract& agreement based upon specific country's constitutional assessment& multistake- holder principle favoured GF mechanism,ethical integration for financial provision,phase funding,fund raised & spent including protection &safeguard of contributor's countries rights,an ethical organisation entity representation,capacity strengthening for capacity gap in grant implementation.Discussion e-forum based upon rolling continuation channel specification could detail predictability of clearer policies& guidelines for contributors countries. The GF mechanism has international health financing &initiative framework for less socio-economical infrastructure countries. In future GF mechanism, innovative financing component could expand formal relationship to partner environment in less GNP& less economy infrastructure countries by providing capacity development support including GF specific payment mechanism based on specific country's international liquidity. There is definitely an urgent need to set clearer and user-friendly policies and guidelines to mitigate conflict of interest within GF processes and structures. The fact that some CCM members are principal and sub recipients needs to be carefully looked at, in order to identify whether decisions have been made in a biased manner - in favour of the CCM members, and whether other organisations which are not represented on the CCM are not sidelined in these processes at national level.

I do however think that in order to overcome some of these challenges, the chair-person of the CCM should not become the Principal Recipient (PR) as it is highly likely that decisions will be biased and unfair to some other organisations. 

It should therefore be regularly clarified that the Chair may not be the PR as it is already a challenge in some countries that the chair is from government while the PR is another government department or ministry.

To avoid conflict of interests all sub-recipients within a country should not sit at all at the CCM.  Instead they can be accommodated in the disease specific committees (the Inter-agency Coordinating Committees) where they would ensure that their interests are taken care of and any issues are articulated and documented for the CCM secretariat to bring to the attention of the CCM. 
 
The CCM should therefore consists of people not implementers from all constituencies that deal with policies and oversight of grants within a country and at no time should the ccm chair be an implementer.

If ccm members are sub recipients of the global fund grant,there will always be conflict of interest during the process of reviewing proposals  for grant because the other members of the ccm can also  be influenced to favour them thereby affecting others that could have benefited from  the grant.With this no good or real results will be seen during monitoring and evaluation, and so the  global fund need to set clearer policies and guidlines to mitigate the inherent conflict of interest.

To, CCM(Conflict of interest) Regarding CCM addressing for conflict of interst,inclusive proposal development process including clearer policies & guidelines based on country's available resources ethical sharing, task interdependence of CCM members,emphasis on common interest, an opportunity to acquire resources& perform activity by CCM members &an affiliated stakeholder,voting member& non voting members could produce relevant & rational mechanism. Social representation,creation of arbitration structure,joint decision making by CCM members i.e.CSO could give an answer in the form of absorption of uncertainty& reduction of conflict. Discussion e-forum based upon civil-society representation could give predictability of clearer policies & guidelines. In CCM proposals development process,civil-society could give social representation of Govt,legal,economical,constitutional institutional mechanism in countries.For above development process degree of civil- society definition,structure,&function may differ in various culture religion& ethnic values based countries. Definition of civil-society could be understood by democratic values, advanced cultural & social institution addressing gender sensitive approaches,reduction of conflict,disagreement,&problematic judgement by assessment of civil rights & liberties. In CCM proposals development process,if civil-society gets an opportunity for participation then it should represent with constitutional, ethical,& formal interaction of community,groups & organisation. Civil-society participation could give rationalism in proposals development process with socio-legal structure exists in countries. Civil-society could interact with grassroot,rural,&affected population for providing civil-rights,articles,judgement,general equilibrium analysis of socio-economic indicators& factors(accessibility of products/services/resources/awareness of economical structures i.e. market,specification,&standardization,agriculture,industry,social structure including hospital,schools,college,family welfare centers, housing,NGO,welfare agencies. GF has complete formal components like CCM,CSS,country proposals, government,&GF secretariat for presentation of GF principles. Distribution of funding component could include development of GF banking provision,community construction with basic housing, micro-finance based on gender education ,family welfare & universal coverage of basic health infrastructure to affected population in countries,could encourage countries to make CCM proposals development process more inclusive. I believe such policies and guidelines are necessary if there are none already.It is not justifiable for a recipient of the Fund to be a member of CCM/Board.If such thing happens, it is just like making oneself a judge over ones case.
If issues that borders on accountability and transparency is brought against such recipient, as human being he is bound to speak in his favour  and try to cover up and thereby justify himself.

I am supporting the regulation that formulate a member of CCM should not to become a PR at their active periods. This is to avoid or prevent Conflict of Interest. Sometimes the person who representing of the organization on CCM misused their position in getting the opportunity to become a PR. After they succeeded become a PR, they usually retired or leaved or not active anymore on CCM, this is because the organization changes the person in charges for representing their organization on CCM. I think.. there is should be a mechanism that ensure the PR should not be a link or puppet of the CCM... vice versa. to me "it doesn't matter the size of COI, tiny or huge the shame is the same"

            Regarding the conflicts of interest with in the CCM, my view ie, the member of CCM is a principle recipient, sub-recipient of LFA there is no problem, it those members may not dominate the other global fund’s partners because they may dominate the other partners of the global fund due to the advantage of members of the CCM. There should be a clear cut rules & regulations, polices of implementation process, selection of global fund’s partners approach and strategies for implementation framed by the global fund’s secretariat this is an unique and should not give any relaxation geographically. The CCm members should serve accordance with country health department and total country’s health budget the member of CCM have to close contact with the local NGOs/PRs/SPR,/LFAs etc. with flexible, there should be a transparency in organization structure, financial background documentation & reporting and evaluation methodology. There all should be framed and follow by the secretariat of the global fund. The CCM and its members have to communicate frequently with the partners of the global fund for progressive implementation of the program with quantitative improvement I feel that global fund secretariat have to set clear policies and guidelines to mitigate the inherent conflict  of interest.

To, CCM(Conflict of interest) Regarding mitigation of an inherent conflict of interest,linkage in the form of CSO&its interaction with grassroot,& AP for providing rights,decision making in selection of PR&SR could produce rational outcome rather than any or potential conflict related with interest of CCM voting members. Discussion e-forum based upon selection& participation of CSO as PR could detail need of clearer policies& guidelines within country's CCM. In selection of CSO as a Principal Recipient & subrecipient,CCM should consider basic GF's CSO framework (Public/private/Academic & research /Multi& bilateral organisation)&its linkage with state/ national plan,governance policies& procedures.In identification of PR& subrecipient,country CCM structure should be more comprehensive& responsive to all national stakeholders.CCM should consult with various stakeholder,LFA,linkage,CSS,& GF secretariat in identification &selection of civil-society organisation as a Principal Recipient.From GF standpoint, number of CCM models i.e. public sector/multisector/NGO/FBO/non health/private,single recipient,civil-society/UNDP/multilateral/South African,are functioning in different regions& countries,only South African CCM model consists of state participation. "Are these models constitutionally,financially,technically,scientifically& appropriately resourced & equipped in country partnership,&selection of specific civil-society as a principal recipient ." this question could give answer of CCM linkage with civil-society structure responsibilities,priorities& partnership. If GFATM(CCM) selects civi-society as a principal recipient then specific civil-society should consist of financial instruments, distribution of funding at country & state level,local NGO level, with expenditure objectives,standard allocation pattern,capacity of general equilibrium analysis with country economic& GDP growth . Civil-society should have provision of disbursal of funding according to socio-economic coverage,various sectors partnership with(trade/tourism/agriculture/industry(construction,mining pharmaceuticals,chemical,scientific& capital goods)education)could scale up CSO activity. GF could give better support to CSO in establishment of socio-economic framework,financial instrument&arrangement framework in countries. If CSO does consider inclusion of expertise enterprize resources structure than its functioning should include all components of grants recipients. To, CCM(Conflict of interest) Regarding mitigation of inherent conflict of interest within CCM& addressing GF mechanism, few monitoring & redress measures could be taken for incompatible objectives of various components of country's CCM i.e. CCM members becomes PR or SR of GF grants without explicit declaration of objectives,capability models & implementation strategies. 1.Monitoring & redress measures could consist of arbitration structure in clause& addressing potential conflict of interest for an appropriate mechanism including evaluation of constrained factors of an independent form & participative form of secretariat,AP &CSO participation in CSS,selection of PR,SR,&OPR,selected PR&OPR should clearly explicit rational course of action not at the cost of other members& stakeholder's interest. 2.CCM should develop structure& management process for determining responsibility of CCM members, an affiliated member,&other discipline including national& state program /dept.for effective country's CCM functioning ,addressing GF mechanism,&general principle with principles of multistakeholder for mitigation of conflict of interest.Above process should provide safeguard provisions for an affiliated & nominated members as recipient for disbursal of funding according to socio-economic impact of diseases in countries. When we talk of clearer policies, guidelines etc, we mean precise, updated and genuine information that will put people on the know so that they act appropriately.
 
The CCM as a body would be expected to face some in house strife from time to time especially where there is communication gap or policies not clearly stated. So in other to reduce or even mitigate the conflict of interest, there is need to set clearer policies, guidelines etc purely garnished with effective communication. As views are different, conflicts of interest are inherent but we try to clearly spell out policies etc to checkmate it.
 
Conflict handled properly, leads to creativity.
